Survivors of Abuse

Residential Institutions Redress Board was set up by the Irish Government under the Residential Institutions Redress Act, 2002. The purpose of establishing this Board is to make fair and reasonable awards to people who, as children, were abused while resident in various institutions in Ireland. Institutions that come under the remit of the Board include industrial schools, reformatories and other institutes in Ireland that were subject to State regulation or State inspection. The Closing Date for receipt of applications was 15th December 2005.

RESIDENTIAL INSTITUTION REDRESS SCHEME TO BE RE-OPENED FOR LATE APPLICATIONS?

Following the recent publication of the Ryan Report considerable discussion has taken place as to how best to serve the victims of abuse.

In a press release of the 18th June 2009 the Labour Party has proposed a Bill entitled “The Institutional Child Abuse Bill, 2009” which proposes to extend the operation of the Residential Institutional Redress Act 2002.

LATE APPLICATIONS:

The Board may at its discretion and where it considers there are exceptional circumstances, extend the time limit beyond 15th December 2005.

In particular, the board will extend the time limit where it is satisfied that an applicant was under a legal disability by reason of unsound mind at the time when the application should otherwise have been made and the applicant concerned makes an application to the Board within three years of the cessation of that disability.

OVER 18’s NOW ELIGIBLE FOR REDRESS!

To date the redress scheme has not compensated applicants if they were over the age of 18 years during the time of the admission to the institutions(s) covered by the scheme

As a result of this recent High Court decision appears to mean that persons who were admitted to care over the age of 18 & under the age of 21 may be eligible for compensation.

APPLICATIONS WHERE APPLICANT HAS DIED AND A GRANT OF PROBATE/LETTERS OF ADMINISTRATION ARE NEEDED TO FINALISE PAYMENT

In cases where an applicant is dead or has died following an award under the scheme, the Board may request that a grant of probate be extracted (where a will exists) or letters of administration be extracted in Ireland to allow payment of the award to those entitled to inherit from the deceased.
